When Medical Malpractice Happens to Children
According to the U.S. Department of Health & Human Services, medical errors are one of the nation's leading causes of death and injury, especially for children who may have trouble communicating their symptoms or getting treatment appropriate to their small size.
At DeVore, Acton & Stafford, PA, in Charlotte, North Carolina, we understand this. While not every medical error is medical malpractice, we take the time to talk with families about the medical errors that happen to their children. We review medical records and consult with knowledgeable experts.
If pediatric malpractice has occurred, we have the resources and experience to help you get the results you deserve. Pediatric malpractice can involve a wide range of errors. Children may be given the wrong medicines or the wrong amount, resulting in medication overdose. Pediatric malpractice may result from failure to diagnose, from a surgical error or from an emergency room error.
In a recent case we handled, a mother took her small child to the emergency room because the child was having difficulty breathing. The child was given a respiratory treatment and admitted to the hospital for an overnight stay. During the night, another respiratory attack occurred. The next day, the mother begged the hospital for further treatment but the child was released from the hospital anyway — in clear violation of hospital policies and procedures. At home later that day, the child suffered another respiratory attack and passed away.
Holding Doctors Accountable for Medical Errors in Children
Many attorneys take only cases involving injuries to working adults with families to support. They do this because these cases are often bring higher jury verdicts and settlements. At DeVore, Acton & Stafford, PA, we do things differently. We understand that the loss of a child is devastating to a family, so we take action to hold pediatricians accountable for malpractice.
